Terms & Conditions

Quotation or Proposal

BlueSkz will provide its clients with either a quote or a proposal outlining the client’s expectations and the BluSkz solution. This will include costs and expectations (as may be required).

Commencement of Work

Acceptance of the quote/proposal from BluSkz constitutes agreement to these terms and conditions.

Fees for Service

BluSkz fee for service shall be the cost estimates provided by quote/proposal.

If work undertaken exceeds the items specified in the quote the Client is expected to pay appropriate fees for the additional work.

BluSkz will provide the client a written ammendment to the quote/proposal should this situation arise and request prior approval before any additional work is commenced.

Payment

BluSkz requires a 50% deposit of the quoted amount to commence any design project, with the balance payable on delivery.

Payment is expected within 7 days of issuing an invoice.

All printing accounts must be settled in full prior to the release of the files to the printer.

Change of Mind

Once design work has commenced on a project the 50% deposit is non-refundable should the client have a change of mind.

BluSkz endeavours to provide graphic and web design services that meet and exceed a client’s expectations, but in the event of a “change of mind” (after a project has commenced) by the client, the initial 50% deposit is forfeited.

Accounts which are not paid on completion may incur  late fees including an administration fee of $20 + 5% of the outstanding project costs for each week payment is outstanding. BluSkz strongly recommends getting in touch prior to completion to make us aware that you may have difficulty paying your invoice on time. We will try and discuss a solution that works for your company.

Approval of Final Artwork

While BluSkz Pty Ltd takes all care to avoid errors, BluSkz Pty Ltd accepts no responsibility for typographical errors, spelling mistakes, or incorrect information on any project committed to print or production. The Client is to proof read and approve all final copy, in writing, prior to BluSkz committing to print or a project being considered as completed.

 No refunds (or reprints in the case of printing) are given due to oversights by the client’s proof reading.

Variations

It should be noted that there may be some colour variations from what you have seen on screen to what the final product looks like on other screens or in printed material. The latter is due to the nature of CMYK printing and BluSkz can not be held responsible for this.

Client Confidentiality

Unless required to disclose by law, we will respect and keep confident any knowledge, information and details obtained during our engagement with our clients.

Copyright

In accordance with the Australian Copyright Act (1968), ‘licensing of copyright is subject to a mutual agreement made between client and designer’. Copyright will remain property of BluSkz until such time as an agreement is in place. 

Once a concept is approved, finished artwork is delivered to a client and full payment is received, the agreed ownership rights to the finished artwork transfer to the client.

BluSkz reserve the right to use stock images or videos in the creation of designs if required. Costs of this will be outlined to the client prior to purchase if not included in the proposal quote.

BluSkz reserve the right to use all artwork produced, concepts produced in the course of the project (including those concepts not selected) and revisions for the purposes of promoting BluSkz in print or digital media portfolios, social media and blogs, except where the client has specifically requested in writing otherwise.

Social Media and Content Management Services

BluSkz has no control over the policies of Facebook, YouTube and all other social media. As such, we have no say with respect to the type of content that social media channels accept now or in the future.

BluSkz can not guarantee that any Social Media Campaign will generate any increase in sales, business activity, profits or any other form of improvement for your business or any other purpose.

It is expected that any elements of text, graphics, photos, designs, trademarks, or other artwork provided to BluSkz for inclusion in any campaigns are owned by you, or that you have received permission from the rightful owner(s) to use each of the elements.

BlueSkz reserves the right to reject or discontinue the social media services where we are unable to provide the services due to technical, ethical, legal, or other matters.
